Sponsor Licence Application
Under current UK immigration rules, businesses must hold a valid Home Office sponsorship licence to employ non-UK resident employees. This includes citizens of the EU, Iceland, Liechtenstein, Norway and Switzerland who arrived in the UK after 31 December 2020. As applying for a sponsorship licence requires a series of documentation and a long application process, the preparation of the entire application is also complicated.
Type of Licence
The type of application for a sponsor license depends on the entry route of the overseas worker who is offered a job by the "sponsor" (the Company). The main work visa types include Skilled Workers, Global Business Mobility and Ministers of Religion. Most work visas in the UK are obtained under the skilled worker route.
The Home Office assesses the ability of employers to meet their requirements, including but not limited to:
-
The business is legally trading in the UK;
-
The company is based in the UK;
-
The company offers jobs that genuinely meet the standards of skilled workers. The company should also have suitable human resources and recruitment systems in place to comply with sponsor licence obligations;
-
The company and its shareholders, directors and key contacts have no criminal record;
-
The company should not pose a threat to immigration controls;
-
After submitting your application, you will receive a licence rating if your application is successful, for example, "A-rating". If you have a rating suitable for your licence, you will be able to issue a Certificate of Sponsorship (CoS).
The licence is valid for 10 years. If the sponsor fails to fulfill their responsibilities as an employer and licensee, they may lose the licence. At the same time, the Home Office may also conduct compliance checks during the validity period of the sponsorship licence.
Depending on the company's situation, there may be additional documents or requirements. Consult immigration experts if necessary.
